This End-User License Agreement ("EULA", "License Agreement") is a legal agreement between you and LSD Team (hereinafter referred to as “LSD Team”, “we”, “us” or https://lsd.team).
This EULA governs your acquisition and use of our "Kersie the Wonder Cherry Stickers" software ("Software") directly from LSD Team or indirectly through a LSD Team authorized reseller or distributor ("Reseller").
Please read this End-User License Agreement carefully before completing the installation process and using the Software. It provides a license to use the "Kersie the Wonder Cherry Stickers" software and contains warranty information and liability disclaimers.
By clicking "accept" or installing and/or using the "Kersie the Wonder Cherry Stickers" software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this License Agreement.
If you are entering into this License Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA, do not install or use the Software, and you must not accept this License Agreement.
This EULA shall apply only to the Software supplied by LSD Team herewith regardless of whether other software is referred to or described herein. The terms also apply to any LSD Team updates, supplements, Internet-based services, and support services for the Software, unless other terms accompany those items on delivery. If so, those terms apply.
This EULA may be modified from time to time. LSD Team will notify you of such modifications on its website or otherwise, e.g. by using the email address you provided when contacting us. Any modifications to this EULA shall only apply upon acceptance by you.
LSD Team hereby grants you a personal, non-transferable, non-exclusive license to use the "Kersie the Wonder Cherry Stickers" software on your devices in accordance with the terms of this End-User License Agreement.
LSD Team shall at all times retain ownership of the Software as originally downloaded by you and all subsequent downloads of the Software by you. The Software (and the copyright, and other intellectual property rights of whatever nature in the Software, including any modifications made thereto) are and shall remain the property of LSD Team.
All Software content, including but not limited to information, lay-outs and images (photos and illustrations) is (and shall continue to be) owned exclusively by LSD Team or our affiliates, licensors, partners, or other contributors to the Software, and is protected under applicable copyrights, patents, trademarks, and/or other proprietary rights, and the copying, redistribution, use or publication by you of any such content or any part of the Software is prohibited.
Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of our Software.
LSD Team reserves the right to grant licenses to use the Software to the third parties.
You are permitted to download the "Kersie the Wonder Cherry Stickers" software (for example to a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the "Kersie the Wonder Cherry Stickers" software.
You are not permitted to:
LSD Team may modify the Software at any time at its sole discretion and without notice to you, for example to comply with applicable law or a court order, to avoid a third party infringement claim or to provide updates and upgrades.
Certain components of the Software are open-source and licensed under the terms of the applicable license. You shall adhere to these terms and conditions, which can be found via the webpage: Open Source Disclosures.
This EULA does not apply to any open-source software which is included in the "Kersie the Wonder Cherry Stickers" application or to any third-party software that is licensed separately under the terms of various separate license agreements (“Other Software”). The Other Software is not subject to the terms and conditions of this License Agreement and is instead licensed to you under the terms of the applicable third-party license agreements (the “Other Software Terms”).
Copyrights to the Other Software are held by copyright holders indicated in the Other Software Terms.
Any terms of this License Agreement that conflict with the terms of any license agreements for Other Software will not apply to the Other Software. Nothing in this License Agreement limits your rights under, or grants you rights that supersede, the terms and conditions of any applicable end user license for the Other Software.
The Software may display, contain links to, or connect with third-party products, services, and websites (collectively, “Third-Party Services”).
Any statements, services, offers, or other information that constitutes part of the Third-Party Services which are accessible through or may be located using the Software are those of the respective authors or producers and not of LSD Team or its stockholders, directors, officers, employees, agents, or representatives.
LSD Team does not control Third-Party Services and does not guarantee the accuracy, integrity or quality of such Third-Party Services. Third-Party Services are governed solely by the Terms and Conditions of those Third-Party Services and LSD Team is not responsible for the performance of and does not endorse any Third-Party Services or any information or materials advertised in any Third-Party Services. LSD Team is not responsible or liable, directly or indirectly, for any damage or loss caused to you by your use of or reliance on any Third-Party Services. It is your responsibility to evaluate the information, opinion, advice, or other services available on and through the Website.
Any information you provide to LSD Team is subject to LSD Team's Privacy Policy, which governs our collection and use of your Personal Data. You understand that through your use of the Software, you consent to the collection and use (as set forth in the Privacy Policy) of this information.
LSD Team may process Personal Data with respect to you, if and to the extent necessary to provide the Software, to provide maintenance and support to you with respect to the Softeare and to comply with our obligations under this EULA. To the extent LSD Team will process Personal Data, it will comply with its obligations under applicable data protection law. Please see our Privacy Policy for more details on the processing of your Personal Data that LSD Team has collected and received through its website.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. LSD TEAM MAKES NO WARRANTY THAT THE SOFTWARE WILL BE UNINTERRUPTED, FREE OF VIRUSES OR OTHER HARMFUL CODE, TIMELY, SECURE, OR ERROR-FREE. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
This EULA is effective from the date you first use the Software and shall continue until terminated. You may terminate it at any time upon written notice to LSD Team.
It will also terminate immediately if you fail to comply with any term of this License Agreement. Upon such termination, the licenses granted by this EULA will immediately terminate and you agree to stop all access and use of the Software as well as remove it from all of your devices.
You acknowledge that the provisions of this EULA, which by their nature are intended to survive termination, will remain in effect after termination of this EULA.
This EULA, and any dispute arising out of or in connection with this License Agreement, shall be governed by and construed in accordance with the laws of the Netherlands, without reference to its conflict of law provisions. All disputes shall be settled by the court of first instance of the place of domicile of LSD Leam.
